Gentlemen, without understanding the history of the state of Jammu & Kashmir, it would be unfair to judge either the Indian Army or the Kashmiris.
During 1947, just when the British were bidding goodbye to India, each state was asked (by British) to sumbit their preference for joining the Indian Union, Pakistan or remain independent. Jammu & Kashmir chose to remain independent joining neither India nor Pakistan. In 1948, Pakistan sent a large number of tribesmen aided by its newly formed army into J & K to annexe it;who immediately embarked on a loot and rape spree. The maharaja of J & K Hari Singh sent an SOS to India requesting military intervention which was rejected by India. On a repeat SOS, India put forward a clause of accession to India ,as a precondition of military intervention which was accepted by Mr. Hari Singh.
The Maharaja signed the Instruement of Accession and the resultant Indian Military campaign managed to drive back the tribesmen when unexpectedly, Jawaharlal Nehru ;the then Indian Prime Minister halted the campaign and started negotiating with Pakistan. As a result, half of Kashmir remains under the control of Pakistani Army till today.
The status quo was maitained till 1987 and there was no terrorism etc , Kashmiris were an extremely hospitable people and the state managed to maintain its status as " paradise on earth", ie. the extent under Indian control free of any communal disturbance. The part under Pakistan has seen little develpement and is strictly under the control of Pakistani Army who use the females as comfort women.
In 1987, the elections in the state of J & K was heavily rigged by the political party Congress with the aid of Dr. Farooq Abdullah, the leader of National Front , a very unpopular and corrupt party. The Kashmiris rose in rebellion which was strictly political and genuine. Pakistan, smelling blood, gave it a communal colour and started sending terrorists to destabilise the state and those terrorists have killed more muslims than people of other religions. Subsequently, the movement deviated to a Muslim vs Non Muslim confrontation which resulted in the muslims driving out all Hindus and Sikhs, rape a large number of their women, kill many of the intelligentia besids wanton destruction of property including Universites and Institutions of public welfare and inflicting a death blow to tourism by specifically targetting tourists.
Indian Army was called in and during these years, there has indeed been some instances of human rights violations by the army but each instance has been investigated and the guilty court marshalled. I should also state that the Indian Medical Corps has earned termendous goodwill among Kashmiris.
The UN resolution calls for plebestcite in Kashmir 'with the demography of the state unchanged'. Today, with every Kashmiri living under the guns of terrorists , plebiscite is virtually impossible. Therefore, India organized elections open to everybody which was contested and won by registered political party ( ies). Note it, terrorists killed and threatened en masse against participating in elections !
India has done humanely the most it can do to nurtue Kashmir but can't afford to hand it over to Pakistan and watch it turning into a training camp of Jehadis.
